Terms of Service

1. Eligibility & Age Requirements

• You must be at least 18 years old, or the age of majority in your jurisdiction, to open an account.
• If you are 13–17, you may use the Services only with the consent and supervision of a parent or legal guardian.
• The Services are not intended for children under 13, and we do not knowingly collect personal information from them (see our Privacy Policy).
• You represent that you are legally able to enter into these Terms.

2. Accounts and Security

To access certain features, you must register for an account. By doing so, you agree to:

• Provide accurate, complete, and updated information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activity under your account.
• Notify us immediately at us.support@seekhoapp.com if you suspect unauthorized access.

We are not responsible for any losses arising from unauthorized use of your account, but you may be liable for losses we or others suffer due to such use.

3. Subscriptions, Trials, and Auto-Renewal

• Subscriptions: Paid subscriptions provide access to premium content and features.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period until canceled.
• Price Changes: We may change subscription prices; you will be notified in advance as required by law. Continued use after the effective date means you accept the new price.
• Disclosure: By purchasing, you agree to ongoing auto-renewal and recurring charges until canceled.

We are not currently offering free trials or promotional subscriptions.

4. Billing, Payments, and Cancellations

• App Store Purchases: If you subscribed through Apple’s App Store or Google Play, billing and refunds are handled exclusively by them under their policies. Refunds on App Store/Google Play purchases are subject to Apple/Google rules.
• Web Purchases: If you subscribed directly via our website, payments are processed through our third-party provider.
• Taxes: Prices may include or exclude applicable taxes depending on your jurisdiction.
• Cancellations:
  iOS: Manage or cancel through your Apple ID account settings.
  Android: Manage or cancel through your Google Play subscriptions.
• Refunds: See our Refunds & Cancellations Policy for details.

5. License to Use the Services

Seekho grants you a limited, non-exclusive, revocable, non-transferable license to use the Services for personal, non-commercial purposes, subject to these Terms.

You may not:

• Copy, modify, distribute, or publicly display our content except as expressly permitted.
• Circumvent or disable any security or DRM features.
• Use bots, scrapers, or unauthorized APIs.
• Upload viruses, malware, or other harmful code.
• Access the Services through automated means that burden our infrastructure.
• Use the Services for unlawful, abusive, defamatory, or harassing purposes.

6. Intellectual Property

• All content, software, and trademarks are owned by Seekho or our licensors. This includes text, graphics, logos, audio, video, source code, and design.
• You may not use our trademarks or branding without our prior written consent.
• If you provide feedback, suggestions, or ideas, you grant Seekho a perpetual, royalty-free, sublicensable license to use them for any purpose.

7. User-Generated Content

Currently, the Services do not enable public posting of user content beyond account/profile information. If in the future we permit content submissions:

• You retain ownership of your content, but grant Seekho a license to host, use, and display it in connection with the Services.
• You represent that you have the rights to the content you submit and that it does not infringe third-party rights.
• We may remove content that violates these Terms, our policies, or applicable law.

8. Copyright Policy (DMCA)

We respect the intellectual property rights of others and request that you do the same.

The Digital Millennium Copyright Act (DMCA) provides recourse for copyright owners who believe material on the Internet infringes their rights. If you believe materials on the Services infringe your copyright, you may send a notice including:

• Your signature (physical or electronic).
• Identification of the copyrighted work claimed to have been infringed.
• Identification of the material claimed to be infringing and its location.
• Your contact information.
• A statement of good-faith belief that use of the material is unauthorized.
• A statement that the information is accurate, and under penalty of perjury, that you are authorized to act for the copyright owner.

Seekho may terminate accounts of repeat infringers.

9. Prohibited Conduct

You agree not to:

• Harass, threaten, or abuse others.
• Impersonate another person.
• Post or share obscene, pornographic, defamatory, hateful, or unlawful content.
• Engage in fraud, scams, or deceptive practices.
• Interfere with or disrupt networks, servers, or infrastructure.
• Reverse-engineer, decompile, or extract source code.
• Violate any applicable laws or regulations.

10. Third-Party Services and Links

• The Services may contain links to third-party websites or integrate third-party services. We do not control, endorse, or assume responsibility for them. Your use of third-party services is at your own risk and may be subject to their terms.

11. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE.”

• We do not guarantee uninterrupted, error-free operation or that the Services will be secure or virus-free.
• Some of the content on Seekho may be created or assisted by artificial intelligence (‘AI’). Such content is provided for informational and educational purposes only.
• Content is provided for educational and entertainment purposes only and does not constitute professional advice.
• We are not responsible for third-party content, services, or advertisements.

Accessibility Disclaimer:
We strive to make the Services usable by a wide audience, but they may not conform to formal accessibility standards (such as WCAG). By using the Services, you acknowledge accessibility features may be limited.

12. Limitation of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEEKHO, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF SEEKHO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE SERVICES;
• UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS;
• ANY THIRD-PARTY CONTENT, STATEMENTS, OR CONDUCT ON THE SERVICES; OR
• ANY OTHER MATTER RELATING TO THE SERVICES.

IN NO EVENT SHALL SEEKHO’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO SEEKHO FOR THE SERVICES IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. NOTHING IN THESE TERMS SHALL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.

13. Indemnification

• You agree to indemnify and hold harmless Seekho, its affiliates, and employees against any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your license ends.
• Certain sections (including disclaimers, limitation of liability, indemnity, and dispute resolution) survive termination.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. You agree that disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Special Terms for U.S. Residents

If you reside in the U.S., you and Seekho agree that any dispute, claim, or controversy arising out of or relating to the Services shall be resolved by binding arbitration under the U.S. Federal Arbitration Act (FAA), administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Informal Resolution First: Before filing arbitration, you agree to email support@seekhoapp.com with a written description of your dispute and allow 30 days for us to attempt to resolve it informally.

CLASS ACTION & JURY WAIVER: YOU AND SEEKHO AGREE THAT ANY PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Small Claims Exception: You may bring an individual claim in small-claims court if permitted in your jurisdiction.

Opt-Out: You may opt out of arbitration and this class-action waiver within 30 days of accepting these Terms by emailing us.support@seekhoapp.com

16. Electronic Communications & Marketing

• By using the Services, you consent to receive electronic communications under the E-SIGN Act.
• Transactional communications (e.g., receipts, notices) are mandatory.
• Marketing emails, SMS, and push notifications are optional, and you may opt out at any time.
• SMS: Consent is not required for purchase. Reply “STOP” to opt out.

17. Miscellaneous

• Assignment: You may not assign these Terms; we may assign them without restriction.
• Force Majeure: We are not liable for events beyond our reasonable control (e.g., natural disasters, strikes, Internet outages).
• Severability: If any provision is invalid, the rest remain enforceable.
• Entire Agreement: These Terms, Privacy Policy, and Refunds Policy form the entire agreement.
• No Waiver: Failure to enforce a provision is not a waiver.
• Headings: Section headings are for convenience only.
